[39] It was quite obvious that the plaintiff (PW1) knew but he chose to evade the truth of the whole matter. The plaintiff (PW1) obviously chose not to speak the truth even though he saw the models that were on display. In my judgment, the contract between the parties was not voidable because the plaintiff (PW1) had the means of discovering the truth with ordinary diligence and the exception to s 19 of the Contracts Act 1950 does not apply.
