This guide explains the standard procedures and requirements a deponent should be aware of when having a document sworn, affirmed, or declared before a Commissioner for Oaths in Malaysia.
Before Your Appointment
- Prepare Your Documents: Ensure your document is complete and ready to be signed. Do not sign it beforehand.
- Bring Valid Original Identification: You must bring your original MyKad (for Malaysian citizens) or your original passport (for non-citizens) or other relevant identification documents.
- Know the Contents of Your Document: You, as the deponent, are responsible for understanding the contents of your document.
During the Appointment
- Verification of Identity: The Commissioner for Oaths will personally check your original ID to confirm your identity. This is a mandatory step.
- Signing the Document:
- You must sign or affix your thumbprint on the document in the physical presence of the Commissioner for Oaths.
- The Commissioner for Oaths will watch you sign and will then sign and seal the document themselves to certify that it was sworn/affirmed before them.
- If there are any corrections or alterations on the document, you are responsible to notify the Commissioner for Oaths on the said corrections or alterations.
- What the Commissioner for Oaths Will Do:
- The Commissioner for Oaths will ensure all legal provisions under the Commissioner for Oaths Rules 2018 are duly complied with.
- They will then affix their official seal and sign the document. Without these three elements—the deponent’s signature, the Commissioner for Oaths’s signature, and the seal—the oath is not considered legally administered.
- If there are any alterations, they would also initial & affix a small seal on the said alterations.

- The Commissioner for Oaths Can Refuse Service: The Commissioner for Oaths has the right to refuse their services if they have credible cause to suspect deception, fraud, duress, or any other illegal conduct.
